1) Conditions of Private
Hire
These conditions apply to the private hire of transport, not operating as
a package, as defined by the Package Travel, Package Holiday and Package
Tour Regulations 1992 (as amended) as governed by English law.
2) Application
a) These conditions apply whether a contract has been made verbally or in
writing.
b) The hirer acts on behalf of all the passengers travelling on the vehicle(s).
c) The hirer is responsible for the actions and decisions of all passengers.
3) Quotations and deposits
a) Quotations are given based on the most direct route.
b) The route will be at the discretion of the company unless it has been
particularly specified by the hirer in which case it will be clearly shown
on
the confirmation.
c) All quotations are given subject to the company having a suitable vehicle
at the time.
d) The hirer accepts the quotations and confirms a booking by paying a deposit
i) 6 seat vehicles £100.00
ii) 16 seat vehicles £100.00
iii) 24 seat vehicles £100.00
iv) 33 seat vehicles £150.00
v) 48 & 49 seat vehicles £150.00
vi) 53 seat vehicles £150.00
vii) For tours of 3 days or more £500.00
e) Quotations are valid for 28 days unless otherwise notified.
4) Route and time variation
a) The company reserves the right to levy additional charges for mileage
or time that was not agreed at the time of booking and confirmed on the
booking confirmation.
b) The vehicle will depart at times agreed by the hirer and it is the responsibility
of the hirer to account for all passengers at those times.
5) Drivers’ Hours
a) Driver’s working hours are regulated by law and bookings are made
to ensure these working hour directives are not breached.
b) Therefore it is important that the times agreed by the company at the
time of booking are kept to.
c) Neither the hirer nor any passengers shall delay or otherwise interrupt
the journey in such a way that the driver is at risk of breaching
regulations relating to driving hours and duty time.
6) Seating capacity
a) The company will specify the legal capacity of the vehicle.
b) The hirer must not load the vehicle beyond this capacity.
7) Conveyance of animals
a) No animals (except guide or hearing dogs notified to the company in advance)
may be carried without prior written agreement from the
company.
8) Confirmation and acceptance
a) A booking is deemed confirmed by the company on the production of a written
confirmation and on receipt of the written acceptance received
from the hirer to confirm booking arrangements and their agreement to these
terms and conditions.
b) A booking is made exclusive of parking, tolls, admission fees and costs
of ferry and Shuttle crossings unless agreed at point of quotation and
acknowledged on the confirmation letter.
9)Privacy policy
No customer financial details will
not be stored by Luxtravel Ltd
10) Payment
a) A deposit must be paid to confirm a booking (see above) and full payment
received 14 days prior to the date of journey.
b) Without receipt of full payment the company may not provide the coach
unless otherwise agreed by the company or for clients who hold an
account with LuxTravel Limited who are bound by the terms of payment agreed
at the time account is opened.
c) Account clients will be invoiced. (Account clients are advised that cancellation
charges apply as set out below and you will be invoiced
accordingly.)
d) The company reserves the right to add 2% compound interest per calendar
month, after the date by which payment should be made.
e) Payment can be made by credit card, debit card, cheque made payable to
LuxTravel, Corams Wood Business Park, Woolpack Corner,
Tenterden Road, Biddenden, Kent TN27 8BH.
11) Cancellation by hirer
a) If a hirer wishes to cancel any arrangements the following scale of charges
will apply in relation to the total hire charge.

Up to 28 days prior to the date of journey The deposit is refundable
27 – 8 days prior to the date of journey The deposit is non-refundable
7 days – 47 hours prior to the date of journey 75% of the hire charge
48 hours or less prior to the date of journey 100% of the hire charge
b) The cost of accommodation, meals and tickets, including ferry and EuroTunnel
crossings which have been purchased by the company at the
request of the hirer will be charged to the hirer plus any administration
charges incurred by the company.
c) Tickets once purchased are not returnable and must be paid in full.
d) Cancellation due to inclement weather conditions will be charged as above.
12) Cancellation by the company
a) In the event of an: -
i) Emergency; ii) Riot; iii) Civil Commotion;
iv) Strike; v) Lock out stoppage; vi) Restraint of labour;
vii) Happening of any event over which the company has no control (including
adverse weather and road conditions);
viii) Or in the event of the hirer taking any action to vary agreed conditions
unilaterally.
ix) The company may return all money paid and without further or other liability,
cancel the contract.
13) Vehicles to be provided
a) The company reserves the right to provide a larger vehicle than that specified
at no additional charge unless the hirer takes additional
passengers and the seats are used.
b) The company reserves the right to substitute other vehicles of similar
quality including those of another operator for all or part of the hiring.
14) Breakdown and delays
a) The company gives advice on journey times in good faith. However if as
a result of: -
i) Breakdown
ii) Traffic congestion
iii) Other events beyond the reasonable control of the company;
journeys may take longer than predicted, the company will not be liable for
any loss suffered by the hirer as a result.
15) Agency arrangement
a) Where the company: -
i) Hires in a vehicle or vehicles from other operators at the request of
the hirer.
ii) Arranges ancillary facilities such as: -
(1) Meals (2) Accommodation (3) Ferries
(4) EuroTunnel crossings (5) Admission tickets (6) Any other services provided
by another supplier
it does so as an agent for and on behalf of the hirer. Any terms and conditions
imposed by such other suppliers shall be binding on the hirer.
16) Passenger property
a) All vehicles hired by the company are subject to restrictions on carrying
luggage for statutory safety reasons.
b) The hirer accepts that the driver shall be the sole judge as to whether
and to what extent passenger’s property is carried.
c) The company does not accept any responsibility for any personal or other
property of the hirer and or their passengers.
d) The hirer should notify the company or driver if items of exceptional
value are to be carried on the vehicle.
e) It is the hirer’s responsibility to minimise the risk of loss when
the property is left unattended.
f) Lost property will be held at the company’s office (address as shown
on your booking confirmation) and is subject to the Public Service Vehicle
(Lost Property) Regulations 1978 (as amended).
17) Conduct of passengers
a) The driver(s) are responsible for the safety of the vehicle at all times
and may remove any passenger(s) whose behaviour prejudices safety or is
breach of the Public Service Vehicle (Conduct of Drivers, Inspectors, Conductors
and Passengers) Regulations 1990 (as amended).
b) The hirer is responsible for any damage caused to the vehicle by any passenger(s)
for the duration of the hire.
c) The hirer may not take on board any dangerous or illegal items.
d) Where the hire is to a sporting event, the hirer should be aware of the
legal requirements relating to alcohol, contained in the Sporting Events
(Control of Alcohol etc) Act 1985 (as amended).
e) Where the hire is to a racecourse, the hire should be aware of the conditions
of entry as laid down by the Race Course association Ltd.
f) The company reserves the right to forbid stops where alcohol can be obtained
on journeys to and from sporting events.
18) Complaints
a) In the event of a complaint, the hirer should seek a solution at the time
by asking for assistance from the driver or representative of the company.
b) If this is not sufficient to resolve the concern then a written account
of the complaint should be submitted with 14 days of the hire to The Director,
LuxTravel Limited (address as shown on your booking confirmation).
19) Notices
a) No bill, poster or notices are to be displayed on any vehicles without
the consent of the company.
20) Smoking, refreshments and alcoholic drinks
a) No smoking or alcoholic drinks are allowed on any of our vehicles.
b) The hirer must have permission from the company before taking food and
beverages onto the vehicles.
c) The hirer must keep our vehicles clean and tidy using the bins and bags
provided.
d) Any damage or excessive mess that requires an outside contractor to clean
or repair will be charged to the hirer.
e) The company reserves the right to charge an appropriate non-returnable
deposit, when at its sole discretion it considers that there is a risk of
the vehicle being returned in an unsatisfactory condition.
21) Surcharges
a) Providing there are 30 days before departure the company reserves the
right to pass on increases in the: -
b) Cost of fuel
c) Taxes imposed by the Government of the United Kingdom and of any other
countries to be visited during the journey
d) Road tolls
e) Foreign currency
f) No surcharges will be levied with 30 days of departure.
g) On notification of such surcharges the hirer may cancel the booking subject
to the scale of cancellation charges shown above
h) The liability of the company will be limited to the cost of the hire and
any ancillary services agreed at the time e.g. ferry or EuroTunnel crossings,
admission tickets.
